"We", "Us", "Our" means Social Care and Social Work Improvement Scotland
"You", "Your" means you - the person and or organisation who has logged on to the eForms Service
"eForms" means electronic forms which can be completed on-line through the eForms Service and submitted to us, for example, electronic annual returns, electronic self evaluation questionnaires for care service providers.
The eForms Service is provided by us to you 'as is'. We do not make any representation or endorsement, or provide a warranty of any kind whether express or implied including, but not limited to, the satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security or accuracy of the eForms Service. We do not warrant that the functions of the eForms Service will be uninterrupted or error free. Your comments and suggestions about the eForms Service are important to us and will inform improvements to the eForms Service. However we do not warrant that defects will be corrected.
We will take all reasonable steps to protect the data you submit via the eForms Service in accordance with prevailing legislation. All data submitted via the eForms Service is encrypted. You should take reasonable steps to protect your username and password and any additional username and passwords which you generate for example to enable your staff to access the eForms Service.
The eForms Service may contain links and references to other websites. We do not accept any responsibility for the content, accuracy or security, or any other feature of external websites.
From time to time, the eForms Service may need to use session cookies. A session cookie is a piece of data which is stored on your computer and which expires once you close down your internet browser. We will use session cookies together with Internet Protocol (IP) addresses to log when you access the eForms Service and to track your progress with eForms. This activity does not collect or store personal information.
You agree to use the eForms Service only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use of the eForms Service by any third party. Such restrictions or inhibitions includes, without prejudice to the generality of the foregoing, conduct which is unlawful, or which might cause interruption to the eForms Service, or which constitutes your acceptance of these terms and conditions. They take effect from the date on which you first use the eForms Service. We may revise these terms and conditions at any time without notice, and therefore you should check them regularly. The continued use of the eForms Service after a change has been made will constitute your acceptance of the change.
The copyright and intellectual property rights in the eForms Service are owned by Social Care and Social Work Improvement Scotland.
These terms and conditions shall be governed by and construed in accordance with the laws of Scotland. Any dispute arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Scotland.
